Terms of Service

1. Introduction

These Terms of Service (“Terms”) govern your access to and use of the EqualiShop platform, website and related services (collectively, the “Service”). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

EqualiShop is operated as a values-led employee rewards platform connecting organisations with diverse and ethical brands.

2. Eligibility

You must be at least 16 years old to use EqualiShop. By using the Service, you represent that you meet this requirement. Access to employer workspaces is limited to individuals who have been invited or approved by their organisation.

3. Accounts

When you create an account you agree to:

• Provide accurate and complete information during registration.
• Keep your login credentials secure and confidential.
• Notify us immediately if you suspect unauthorised access to your account.
• Accept responsibility for all activity that occurs under your account.

We reserve the right to suspend or terminate accounts that violate these Terms or that remain inactive for an extended period.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
• Share, redistribute or publicly disclose discount codes, offers or tracked links intended for your organisation’s members only.
• Attempt to gain unauthorised access to any part of the Service, other accounts or related systems.
• Use automated scripts, bots or scraping tools to access or collect data from the platform.
• Interfere with or disrupt the integrity or performance of the Service.
• Impersonate another person or entity, or misrepresent your affiliation with an organisation.

5. Discount Codes and Brand Offers

EqualiShop provides access to discount codes and offers from third-party brand partners. Please note:

• Codes and offers are provided “as available” and may be subject to additional terms set by the brand.
• We do not guarantee the availability, accuracy or validity of any particular offer.
• When you click through to a brand’s website, your transaction is directly with that brand and is subject to their own terms, privacy policy and returns policy.
• EqualiShop is not a party to any purchase you make through a brand partner and is not liable for any disputes arising from such purchases.

6. Employer Workspaces

Organisations that subscribe to EqualiShop receive a private workspace for their employees. Employer administrators may:

• Invite and manage team members within their workspace.
• Access aggregate engagement analytics (individual browsing details are never shared with employers).
• Customise branding and available features for their workspace.

Employers are responsible for ensuring that their use of the platform complies with applicable employment and data protection laws.

7. Intellectual Property

All content, design, graphics, logos, software and other materials on the EqualiShop platform are owned by or licensed to EqualiShop and are protected by copyright, trademark and other intellectual property laws. You may not reproduce, distribute or create derivative works from any part of the Service without our prior written consent.

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use and protect your personal data. By using the Service, you acknowledge that you have read and understood our Privacy Policy.

9. Limitation of Liability

To the fullest extent permitted by law:

• The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied.
• EqualiShop shall not be liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the Service.
• Our total liability for any claim arising from or relating to the Service shall not exceed the amount you have paid to us (if any) in the twelve months preceding the claim.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under applicable law.

10. Indemnification

You agree to indemnify and hold harmless EqualiShop, its officers, employees and partners from any claims, damages, losses or expenses (including reasonable legal fees) arising from your breach of these Terms or misuse of the Service.

11. Termination

You may close your account at any time by requesting deletion through your profile settings or by contacting support. We may suspend or terminate your access if you breach these Terms, with or without notice. Upon termination, your right to use the Service ceases immediately, and we may delete your data in accordance with our Privacy Policy and data retention practices.

12. Changes to These Terms

We may update these Terms from time to time. The date at the top of the page shows when they were last revised. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms. Where changes are material, we will notify you via the platform or by email and may require you to re-accept the updated terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.
